Terms & Conditions of Use and Sale (Nikki & Marco Photography)

Welcome to the online gallery and shop of Nikki & Marco Photography

("We", "Us", or "Our"). These terms govern both your use of our website and any purchases you make. By using this website or buying our products, you agree to be bound by these terms, which are governed by English Law.

Part A: Website Terms of Use (General Visitors)

A1. Copyright and Intellectual Property

All content on this website, including all photographs, images, graphics, text, and other materials (collectively, "Content"), is the property of Nikki & Marco Photography and is protected by UK and international copyright laws (Copyright, Designs and Patents Act 1988). We retain the full worldwide copyright of all images at all times.

A2. Permitted Use

You may access and view the website content for personal, non-commercial use only. You are permitted to share links to gallery pages on personal social media, provided credit is given to "Nikki & Marco Photography".

A3. Prohibited Use

You are expressly prohibited from:

·       Copying/Downloading: Saving, screenshotting, downloading, reproducing, publishing, or distributing any content without a purchase or written license. Images on the website are for viewing only.

·       Commercial Use: Using any images for commercial purposes, advertising, or any profit-generating activities.

·       Modification: Altering, editing, cropping, or applying filters to the images without prior written permission.

·       Unauthorized Hosting: Uploading the images to another website or server.

Unauthorized use constitutes a breach of copyright and may lead to legal action.

Part B: Terms and Conditions of Sale (Purchases)

These terms apply when you (the "Buyer" or "Consumer") purchase products (prints or digital downloads) from our online shop.

B1. Ordering and Contract Formation

·       Order Process: You place an order on the site by selecting products and completing the checkout process. Please check your order carefully before submitting it.

·       Acceptance: We will acknowledge your order by email. A legally binding contract is formed when we dispatch the physical goods or when the digital download is made available to you. We reserve the right not to accept your order for reasons such as product unavailability or payment issues.

B2. Pricing and Payment

Prices are as displayed on the website and include VAT where applicable. Payment must be made in full at the time of ordering via the accepted payment methods.

B3. Delivery

·       Physical Goods: We will deliver goods within 30 days unless a different timeframe is agreed. The retailer is responsible for the condition of goods until they are received by you.

·       Digital Downloads: Access to digital content will be provided immediately or shortly after payment confirmation via a secure link. You must ensure your device meets the necessary technical requirements to download and view the content.

B4. Consumer Rights, Returns, and Refunds (UK Specific)

B4.1 Physical Prints/Goods

Under the Consumer Contracts Regulations 2013, you have a statutory right to cancel your order for a full refund (including standard delivery costs) within 14 days of receiving your goods.

·       To cancel, you must inform us of your decision to cancel.

·       You then have another 14 days to return the goods to us at your own cost.

·       We will process the refund within 14 days of receiving the returned goods.

·       Goods must be returned in satisfactory condition.

B4.2 Digital Downloads (IMPORTANT)

When purchasing digital content (image files for download), you usually waive your 14-day cancellation right if you consent to immediate download and acknowledge this waiver at the point of purchase. We will ask for your explicit consent to this during the checkout process.

B4.3 Faulty Products

Under the Consumer Rights Act 2015, all products (physical and digital) must be as described, fit for purpose, and of satisfactory quality.

·       If a product is faulty, you are entitled to a repair or replacement. If this is not possible or takes too long, you are entitled to a full or partial refund.

·       Contact us immediately if you believe a product is faulty.

B5. Usage License for Purchased Images

Purchasing an image grants you a specific license, but not the copyright. The license details depend on the product purchased (as described in the product listing):

·       Personal Use License (Standard for most consumer purchases): You may print the image for personal display and use the provided digital files on your personal devices and social media (with credit). This does not allow commercial use, editing (beyond basic resizing), or distribution to third parties for their own use.

·       Commercial Use License: A separate, specific written agreement is required for any commercial use and is subject to different fees.

B6. Limitation of Liability

Our maximum liability for any breach of contract shall be limited to the price paid for the product in question. We are not liable for any indirect or consequential loss.

We process your personal data in accordance with UK GDPR and our Privacy Policy, which is available on this website.
